Introduction 1.1 The aim of the Tendring Youth Assembly (TYA) is: “ To be a pro-active and friendly group who voice the opinions of young people. We work together to improve services for teenagers in Tendring and help promote a positive image ” . 1.2 The Tendring Youth Assembly was established by Tendring District Council to enable young people to be represented in the Tendring district. The TYA is Tendring District Council ’ s primary consultative group on youth issues and as a result is recognised as the official voice of young people at district level in the local democracy structure for young people (reference: Inf. Cabinet 06/09/06). 2. Membership of the Tendring Youth Assembly 3.1 The Tendring Youth Assembly will consist of a maximum of 25 elected representatives from recognised youth groups, including schools and youth centres, in the Tendring District. 3.2 The members must be aged 12 to 19 and reside in the Tendring District. 3.3 The TYA will reflect the make-up of the general public; it will not discriminate against any individual regardless of gender, background or ethnicity. 3.4 TYA members will give their free time to attend meetings and carry out tasks on behalf of the TYA. 3.5 TYA members must choose or be allocated a division (County Council division) which they are responsible for representing. 3.6 Members who are 18 and 19 years of age must become senior TYA members where they must receive Child Protection training and undergo a Criminal Records Bureau check. 4. Appointments and selections 4.1 Prospective members must fill in an application form and in this show evidence that they have been nominated by the group they represent. 4.2 Prospective members must also collect 25 signatures of 12-19 year olds who live in the Tendring district to support their nomination. 5. Length of membership 5.1 A member who leaves the Tendring district or reaches their 20th birthday will give up their place on the TYA. 6. Role and Responsibilities of the Chair and management team 7.1 The Chair of the TYA (with assistance from the coordinator) will have responsibility for ensuring that the tasks of the TYA are carried out through the members, and in accordance with the Terms of Reference. They will act (with assistance from the coordinator) as contact and signatory for agreements on behalf of the group. They will also have an additional casting vote. 7.2 The vice chair will take the place of the Chair and carry out his or her responsibilities where necessary. 7.3 The secretary will deal with all written correspondence with assistance from the coordinator. 7.4 The TVYC technical adviser will be responsible for updating members on the progress of the Tendring Virtual Youth Centre website, make changes to the website where permitted and propose improvements to the site. 7.5 The treasurer will inform the TYA of funds available to the TYA, will advise on expenditure and deal with applications for funding with the coordinator. 8. If the vice chair is unable to chair the meeting a temporary chair will be elected. 8.4 If the Chair of a meeting of the TYA considers that a TYA member persistently disregards the ruling of the Chair and/or behaves in an offensive way and/or wilfully obstructs the business of the meeting the Chair may;  require the member concerned to stop speaking during all or part of the remainder of the meeting;  request that a vote be taken that the member of the TYA concerned leave the meeting. This must be decided without comment and if carried by two-thirds majority of those present, the member concerned shall forthwith leave the meeting; and/or  adjourn the meeting for such period as shall seem expedient. 9. Meetings 9.1 Meetings will be held once a month, excluding August due to the school summer holiday break. 9.2 Visitors who attend have observer status and can only contribute to the meeting if notice has been given to the Chair in advance of the meeting, or in exceptional circumstances if the Chair permits. 9.3 Items for the agenda must be submitted to the Management Team for approval. 9.4 The agenda and supporting papers will be circulated by the coordinator of the TYA a minimum of five working days before the meeting. 9.5 The meetings will be supported and minuted by the coordinator. 10. Voting 10.1 The decisions of the TYA will be decided by a majority of votes of those present at a quorate meeting. 10.2 All members of the TYA will have equal votes. The Chair will have a vote as a member and in the event of a vote being tied will have a second and casting vote. 11. Quorum 11.1 Meetings of the TYA are quorate if there are at least 6 voting members present. No decisions can be made by the TYA without a quorum present. 11.2 Meetings of the TYA management team are quorate if there are two members present. No decisions can be made by the TYA management team without a quorum present. 12. Confidentiality 13.1 TYA meetings are not open to the public but minutes and agendas are available to the public on the Tendring Virtual Youth Centre. Occasionally there may be confidential information presented to the TYA which should be agreed as being confidential by the Chair through consultation with the coordinator. 13.2 However where agenda items contain information that is then agreed as confidential, members of the public will be excluded and relevant documentation will not be made publicly available. The type of information that will be treated as confidential may include:  Individuals ’ personal details.  Unconfirmed proposals, which could lead to the spread of misinformation.  Confirmed proposals which should not be publicised until a certain date. 14. Conflict of interests 14.1 A conflict of interest may arise where a member of the TYA or an organisation they are linked to could benefit or be disadvantaged by a TYA decision. 14.2 A register of interests made in accordance with the Tendring District Council Code of Conduct for members will be held by the TYA coordinator. The individual TYA members are responsible for entering in this register any interests they have and for updating his/her entries in this register. 14.3 Members must declare any interests they have in any matter to be considered. Where the interest in the matter is such that it is prejudicial the member concerned must not vote and must leave the meeting during consideration of that matter. Should any interests be found not to have been declared, that TYA member can be removed from the TYA and a complaint made to the Standards Board for England if the Board member is an elected Councillor. 15. Appointment and Removal of Members 15.1 Appointment and removal of members shall be in such form and contain such information as the TYA may prescribe. They will take effect when received in writing by the member and the coordinator. The TYA will give that member;  at least seven days written notice of a TYA meeting where any discussion about the replacement of a TYA member will take place and written details of the reasons for discussion (e.g. a complaint has been received); and  an opportunity to be heard and represented at that meeting. 15.5 In the event of a dispute as to the appointment of any member, the TYA may decide the matter and the decision of the TYA will be final and conclusive. 16 Attendance of Members 16.1 Members of the TYA are expected to attend TYA meetings and if absent for 3 consecutive meetings, their position on the TYA will be reviewed. If members miss more than half a meeting this will be considered an absence. 17 Code of conduct 17.1 All members will adhere to the agreed Code of Conduct (Appendix A). If any member of the TYA is found by the TYA to be in breach of the Code of Conduct they may be asked to leave the TYA. The TYA must decide on a majority vote;  whether the TYA member is in breach; and  whether this justifies removal from the TYA. 18 Health and safety 18.1 The TYA will follow the procedures outlined in the Tendring District Council ’ s Health and Safety Policy. 19 Equal opportunities 19.1 The TYA will work to Tendring District Council ’ s Equality and Diversity Policy. operate equal opportunities policies and practices in all aspects of its work. 20 Support for TYA Members 20.1 Travel and Subsistence Costs Authorised travel costs will be covered by Tendring District Council. Booking of taxis for TYA meetings are automatically authorised. However for ad hoc meetings or events, permission from the coordinator must be sought to book a taxi paid for by Tendring District Council. This code of conduct has been produced so that in the unlikely event that a member behaves in a way that is of concern to other members of the TYA, rules exist to deal with the situation. 2 Working Together 2.1 Collective decisions TYA members will inevitably have differences of opinion on issues under debate. This is healthy. After full discussion, when the TYA has made a decision, all members must uphold this decision. Speaking against any TYA decision in public will undermine the TYA. Hence each TYA member has a responsibility to stand by collective decisions of the TYA and to present a unified front in public. 2.2 Respect TYA members must respect each other and each other ’ s opinions. Differences of opinion are welcomed and debate must not be acrimonious or personal. In meetings TYA members must listen to each other and respond to each other politely. All contributions at meetings must go through the Chair. Where necessary constructive criticism is the most welcome form of feedback. Mobile phones must be switched off or turned to silent while meetings are in progress. Private and personal conversations must be kept to the break and outside of the meeting. All communication via the TVYC public and TYA forum, e-mail, letter and telephone must be polite and appropriate. 2.3 Diversity We are all different. TYA members will respect and welcome this diversity. In all the TYA ’ s work, members will treat other TYA members and those affected by the work of the TYA fairly.
